많은 분들이 EB-2 NIW(National Interest Waiver, 국익면제) 영주권을 준비하면서 절차를 비교적 단순하게 생각합니다. NIW 청원을 접수하고 승인을 받은 뒤, 이민비자 인터뷰를 거쳐 영주권을 받는 과정이라고 이해하는 경우가 많습니다.

​

하지만 실제 이민 절차는 케이스마다 매우 다르게 진행됩니다.

​

이번 사례는 일반적인 진행 과정과는 상당히 다른 여정을 거쳤습니다. 약 2년 7개월에 걸쳐 학사 학위만으로 EB-2 고학력 전문직(Advanced Degree Professional) 자격을 인정받았고, NIW 심사의 세 가지 핵심 요건 모두에 대한 RFE(Request for Evidence, 추가증거요구)를 극복했습니다. 이후 비자문호의 변동, NVC(National Visa Center)의 운영 방식 변화, 미국 입국 후 신분조정(Adjustment of Status)으로의 전략적 전환 등을 거쳐 최종적으로 미국 영주권 승인을 받았습니다.

현재 신청인과 가족은 I-485 신분조정이 모두 승인되었으며, 자택으로 배송 중인 영주권 카드를 기다리고 있습니다.

이 사건에서 가장 먼저 검토해야 했던 부분은 신청인이 EB-2의 기본 자격을 충족하는지 여부였습니다.

​

많은 NIW 신청자들이 석사 또는 박사 학위를 보유하고 있는 것과 달리, 이번 신청인은 컴퓨터공학 학사 학위만을 보유하고 있었습니다. 그러나 소프트웨어 엔지니어로 근무하면서 점진적으로 전문성과 책임 범위를 확대해 온 경력을 갖추고 있었습니다.

미국 이민법상 학사 학위와 함께 학위 취득 이후 5년 이상의 점진적인 전문 경력을 보유한 경우에는 고학력 전문직(Advanced Degree Professional)으로 인정받을 수 있습니다.

​

이번 청원에서는 단순히 근무 연수만을 제시한 것이 아니라, 수행 업무의 난이도 변화, 기술적 책임의 확대, 프로젝트 리더십, 그리고 경력 전반에 걸친 전문성의 성장 과정을 구체적으로 입증하였습니다. 이를 통해 신청인의 경력이 고학력 전문직에게 요구되는 수준의 전문성을 충분히 보여준다는 점을 설명하였습니다.

결과적으로 USCIS는 신청인이 EB-2 기본 자격을 충족한다고 판단하였습니다.

■ NIW 청원 접수

​

NIW 청원은 2023년 12월 14일, 신청인과 가족이 한국에 거주하던 당시 접수되었습니다.

​

당시에는 한국 주재 미국대사관에서 이민비자를 발급받는 영사절차(Consular Processing)를 통해 미국 영주권을 취득하는 것이 계획이었습니다.

​

비록 당시에도 취업이민 문호 적체는 존재했지만, NIW 청원을 접수함으로써 우선일자(Priority Date)를 확보하고 영주권 절차를 시작할 수 있었습니다.

​

​

​

​

■ NIW 세 가지 심사 요건 모두에 대한 RFE

​

2024년 4월 30일, USCIS는 추가증거요구(RFE)를 발행했습니다.

​

이번 RFE는 단순히 일부 사항에 대한 보완을 요청한 것이 아니라, Matter of Dhanasar 판례에서 제시한 NIW의 세 가지 핵심 요건 모두에 대해 추가적인 설명과 입증을 요구했습니다.

​

- 신청인의 계획이 실질적인 가치(Substantial Merit)와 국가적 중요성(National Importance)을 갖추고 있는지

- 신청인이 해당 계획을 성공적으로 수행할 수 있는 역량을 갖추고 있는지

- 고용제안(Job Offer)과 노동허가(Labor Certification)를 면제하는 것이 미국 국익에 부합하는지

​

세 가지 요건 모두에 대한 RFE를 받게 되면 USCIS가 모든 요소에 대해 충분히 납득해야만 최종 승인이 가능하기 때문에 신청인 입장에서는 상당한 부담으로 느껴질 수 있습니다.

​

이에 기존 청원서에 포함되어 있던 자료를 더욱 보강하여 추가 증거, 최신 산업 자료, 보다 구체적인 법률적 설명, 그리고 소프트웨어 엔지니어로서 수행하려는 계획에 대한 상세한 설명을 제출하였습니다. 또한 신청인의 전문성, 주요 성과, 그리고 해당 업무가 미국에 갖는 국가적 중요성을 보다 폭넓게 입증하는 자료들도 함께 보완하였습니다.

​

이후 USCIS는 제출된 RFE 답변을 검토한 끝에 2024년 8월 7일 NIW 청원을 승인하였습니다.

​

​

■ 영사절차(Consular Processing) 진행

​

NIW 승인 이후 사건은 국립비자센터(NVC) 단계로 넘어갔습니다.

​

당시 NVC의 운영 방식은 현재 많은 NIW 신청자들이 경험하는 절차와는 다소 차이가 있었습니다.

​

당시에는 비자문호상 우선일자가 아직 도래하지 않았음에도 NVC가 DS-260 이민비자 신청서와 민사서류 제출을 허용하였습니다. 그 결과 비자가 실제로 배정되기 전임에도 서류 심사를 모두 완료하여 '서류심사 완료(Documentarily Qualified, DQ)' 상태까지 진행할 수 있었습니다.

​

이번 사례에서는 DS-260 제출 후 불과 21일 만에 DQ를 완료하였습니다.

​

반면 최근에는 NVC의 운영 방식이 취업이민 신청자들에게 보다 보수적으로 적용되는 사례가 늘어나고 있습니다. 우선일자가 비자문호상 도래하기 전에는 DS-260 제출 자체를 안내받지 못하는 경우가 많으며, 그 결과 서류 심사 단계조차 시작하지 못한 채 추가적인 대기 기간이 발생하는 사례가 적지 않습니다.

​

그러나 DQ를 완료했다고 해서 곧바로 인터뷰를 받을 수 있었던 것은 아니었습니다.

​

당시 주한미국대사관의 취업이민 인터뷰 적체는 매우 심각한 수준이었으며, 인터뷰 대기 기간은 2년 이상으로 늘어나 있었습니다.

​

NVC 단계의 절차는 모두 완료되었지만, 실제 인터뷰를 진행할 수 있는 현실적인 길은 당분간 열리지 않은 상황이었습니다.

​

​

■ 미국에서 찾아온 새로운 기회

​

영사절차를 계속 기다리던 중 신청인의 상황에도 중요한 변화가 생겼습니다.

​

2025년 초, 신청인은 L 비자를 통해 미국에서 근무할 수 있는 기회를 얻게 되었습니다.

​

동시에 취업이민 비자문호는 다시 후퇴하면서 영사절차를 통한 이민비자 발급 시점도 더욱 늦어졌습니다.

​

NIW를 처음 접수했을 당시만 해도 모든 절차는 한국에서 인터뷰를 거쳐 영주권을 취득하는 방향으로 계획되어 있었습니다.

​

하지만 이제는 새로운 선택지가 생겼습니다.

​

신청인이 미국에서 합법적으로 체류하며 근무하게 되면서, 향후 비자문호가 다시 열릴 경우 미국 내 신분조정(Adjustment of Status)을 진행할 수 있는 현실적인 가능성이 생긴 것입니다.

​

​

■ 전략적인 선택

​

이후 비자문호가 다시 신분조정 접수가 가능한 상태로 회복되었습니다.

​

가족은 계속해서 한국에서 인터뷰를 기다릴 것인지, 아니면 미국에서 신분조정을 진행할 것인지 신중하게 검토했습니다.

​

두 가지 방법 모두 장단점이 있었습니다.

​

영사절차를 유지하면 새로운 신청서를 다시 제출할 필요는 없었지만, 주한미국대사관의 인터뷰 적체는 여전히 해소되지 않은 상황이었습니다.

​

반면 신분조정은 추가 비용과 상당한 서류 준비가 필요했지만, 2026년 3월 이후 USCIS는 EB-2 신분조정 신청을 비교적 빠르게 심사하기 시작했습니다.

​

여러 요소를 종합적으로 검토한 끝에 신청인은 “Two-track” 전략을 선택했습니다.

​

기존 영사절차는 그대로 유지하면서 미국에서는 신분조정을 동시에 준비하기로 한 것입니다.

​

이후 약 한 달 동안 한국과 미국을 오가며 필요한 서류와 증빙자료를 준비했습니다. 비자문호가 열리면서 신분조정 신청이 한꺼번에 증가할 것으로 예상되었기 때문에, 심사관이 명확하고 설득력 있게 검토할 수 있도록 신청서를 최대한 체계적으로 준비하는 것이 중요했습니다.

​

■ 신분조정 승인

​

USCIS는 2026년 4월 10일 신분조정(I-485) 신청서를 접수하였습니다.

​

이번 사건은 과거 미국 비자 이력과 경미한 형사 관련 사항에 대한 설명 및 추가 입증이 필요한 사례였습니다.

이에 관련 사실과 법적 요건을 충분히 설명하고 필요한 자료를 함께 제출함으로써 USCIS가 사건을 종합적으로 검토할 수 있도록 준비하였습니다.

​

그리고 2026년 7월 17일, USCIS는 신청인과 가족 모두의 신분조정을 승인하였습니다.

​

현재 신청인 가족은 영주권 카드가 우편으로 배송되기를 기다리고 있습니다.

​

영주권을 수령하면 더 이상 L 비자를 유지하거나 특정 스폰서 고용주에게 계속 근무해야 할 필요가 없습니다. 영주권자로서 자유롭게 직장을 변경하거나 새로운 기회를 선택할 수 있으며, 임시 취업비자에 의존하지 않고 미국에서 안정적으로 생활할 수 있게 됩니다.

■ 이 사례가 보여주는 점

​

이번 사례는 NIW 절차에서 몇 가지 중요한 점을 보여줍니다.

​

첫째, 성공적인 NIW 신청자가 반드시 석사나 박사 학위를 보유해야 하는 것은 아닙니다. 구체적인 경력과 사실관계에 따라서는 학사 학위와 점진적인 전문 경력만으로도 EB-2 고학력 전문직 자격을 인정받을 수 있습니다.

​

둘째, NIW의 세 가지 심사 요건 모두에 대한 RFE를 받았다고 해서 반드시 불리한 결과로 이어지는 것은 아닙니다. USCIS가 제기한 사항을 충분한 증거와 논리로 설명한다면 승인으로 이어질 수 있습니다.

​

셋째, NIW 승인은 곧바로 영주권 취득을 의미하지 않습니다. 비자문호, NVC 운영 방식, 대사관 인터뷰 적체, 그리고 신청인의 상황 변화에 따라 영주권 취득까지의 과정은 얼마든지 달라질 수 있습니다.

​

마지막으로, 이민 전략은 고정되어 있는 것이 아닙니다. 상황이 변화할 때마다 가장 적절한 선택지를 검토하고 전략을 유연하게 조정하는 것이 성공적인 영주권 취득으로 이어질 수 있습니다.

2023년 12월 한국에서 접수한 NIW 청원은 2026년 7월 미국 내 신분조정 승인으로 마무리되었습니다.

​

이번 사례는 성공적인 미국 이민이 단순히 청원서 승인에 그치는 것이 아니라, 변화하는 상황에 맞춰 전략을 세우고 유연하게 대응하는 과정이라는 점을 보여주는 사례라 할 수 있습니다.

From South Korea to U.S. Permanent Residence: A Real NIW Case Review

​

A Bachelor's Degree,

For many professionals considering an EB-2 National Interest Waiver (NIW), the immigration process appears straightforward: file the NIW petition, obtain approval, attend an immigrant visa interview, and receive a green card.

​

In reality, every case is different.

​

This case followed a very different path. Over the course of more than two and a half years, the petitioner qualified for the advanced degree EB-2 category with a bachelor's degree, overcame a Request for Evidence addressing all three NIW eligibility requirements, navigated changing Visa Bulletin conditions, adapted to evolving National Visa Center processing practices, transitioned from consular processing to Adjustment of Status after relocating to the United States, and ultimately obtained approval of permanent residence.

​

Today, the petitioner and family members are waiting for their green cards to arrive in the mail.

■ Qualifying for the EB-2 Category

​

One of the first questions in this case involved the petitioner's eligibility for the underlying EB-2 classification.

​

Unlike many NIW applicants, the petitioner did not hold a master's degree or doctorate. Instead, the petitioner held a bachelor's degree in Computer Engineering and had built a successful career as a software engineer with progressively increasing technical responsibilities.

​

Under U.S. immigration law, an individual may qualify as an advanced degree professional through a bachelor's degree combined with at least five years of progressive post-baccalaureate experience that is equivalent to an advanced degree.

​

For this case, the petition carefully documented not only the petitioner's years of experience, but also the increasing complexity of the work performed, expanding technical responsibilities, leadership within engineering projects, and professional growth throughout the petitioner's career. The petition demonstrated how the petitioner's experience reflected the level of expertise expected of an advanced degree professional.

​

USCIS ultimately agreed that the petitioner met the underlying EB-2 classification requirements.

​

​

■ Filing the NIW Petition

​

The NIW petition was filed on December 14, 2023, while the petitioner and family were residing in South Korea.

​

At that time, the intention was to complete the immigration process through the U.S. Embassy in Seoul using consular processing.

​

Although immigrant visa backlogs already existed, filing the NIW petition established the family's priority date and allowed the permanent residence process to begin.

​

​

​

​

■ Request for Evidence on All Three NIW Requirements

​

On April 30, 2024, USCIS issued a Request for Evidence (RFE).

​

Rather than requesting clarification on a single issue, the officer requested additional evidence addressing all three requirements established under Matter of Dhanasar:

​

- Whether the proposed endeavor possessed substantial merit and national importance;

- Whether the petitioner was well positioned to advance the proposed endeavor; and

- Whether, on balance, waiving the job offer and labor certification requirements would benefit the United States.

​

Receiving an RFE covering all three NIW requirements can be intimidating because it requires USCIS to be satisfied on every element before approval can be granted.

​

The response further supplemented the existing record with additional supporting evidence, updated industry information, expanded legal analysis, and a comprehensive explanation of the petitioner's proposed endeavor as a software engineer. Additional documentation was also provided to further demonstrate the petitioner's qualifications, professional achievements, and the national importance of the work.

​

After reviewing the response, USCIS approved the NIW petition on August 7, 2024.

​

​

​

​

■ Moving Forward Through Consular Processing

​

With the NIW petition approved, the case proceeded to the National Visa Center (NVC).

​

At the time this case progressed through NVC, operational procedures differed from what many NIW applicants experience today.

​

Although the petitioner's priority date was not yet current under the Visa Bulletin, NVC accepted the submission of the DS-260 immigrant visa application and supporting civil documents. This allowed the case to complete document collection and become “Documentarily Qualified (DQ)” while continuing to wait for immigrant visa availability.

​

In this case, the petitioner became documentarily qualified only 21 days after submitting the DS-260.

​

In more recent years, however, NVC's operational approach appears to have become more restrictive for many employment-based applicants. Rather than allowing document collection before visa availability, applicants often must wait until their priority date becomes current before they are invited to submit the DS-260 and supporting documentation. As a result, many applicants today experience an additional period of waiting before document review can even begin.

​

Despite becoming documentarily qualified, another obstacle remained.

​

The U.S. Embassy in Seoul was experiencing significant immigrant visa interview delays, with interview wait times extending beyond two years due to limited appointment capacity.

​

Although the case had completed NVC processing, there was simply no immediate path to an immigrant visa interview.

​

​

​

​

■ A New Opportunity in the United States

​

While continuing to wait for progress in consular processing, the petitioner's career took an unexpected turn.

​

In early 2025, the petitioner accepted an opportunity to work in the United States under an L visa.

​

At the same time, the employment-based Visa Bulletin experienced further retrogression, pushing immigrant visa availability even farther into the future for consular processing applicants.

​

When the NIW petition had originally been filed, the expectation was that the family would complete the immigration process through the U.S. Embassy in Seoul.

​

Now, however, another option became available.

​

Because the petitioner was lawfully present and working in the United States, Adjustment of Status became a realistic alternative if the visa bulletin opened up.

​

​

​

​

■ A Strategic Decision

​

Eventually, the Visa Bulletin once again became current for Adjustment of Status.

​

Although the family could have continued waiting for an immigrant visa interview in Seoul, they carefully considered whether Adjustment of Status would provide a faster path to permanent residence.

​

Each option presented advantages and disadvantages.

​

Continuing with consular processing would avoid filing a second set of immigration applications, but the embassy interview wait time remained significant.

​

Adjustment of Status required additional filing fees and substantial documentation, but USCIS had begun adjudicating employment-based Adjustment of Status applications relatively quickly after visa availability for the EB-2 category resumed in March 2026.

​

After carefully weighing both options, the petitioner decided to pursue a “two-track” strategy.

​

The consular processing case remained available while Adjustment of Status was simultaneously prepared and filed in the United States. Over the following month, documents and supporting evidence were coordinated between South Korea and the United States to prepare the applications. Since there would be a sudden increase in Adjustment of Status applications, it was important to make the application as clear and convincing as possible.

​

■ Adjustment of Status Approval

​

USCIS received the Adjustment of Status application package on April 10, 2026.

​

The case required careful preparation because it involved prior U.S. visa history as well as a minor criminal matter that required explanation and supporting documentation.

​

By thoroughly documenting the relevant facts and addressing the applicable immigration requirements, the application presented a complete record for USCIS's review.

​

On July 17, 2026, USCIS approved the Adjustment of Status applications.

​

Today, the petitioner and their family members are waiting for their physical green cards to arrive in the mail.

​

Once the green cards are issued, the petitioner's ability to live and work in the United States will no longer depend on maintaining L visa status or continued employment with their sponsoring employer. They now have the flexibility to change employers, pursue new opportunities, or remain in the United States without relying on a temporary work visa.

​

​

■ Lessons From This Case

​

This case illustrates several important aspects of the NIW process.

​

First, not every successful NIW applicant holds a master's degree or doctorate. Depending on the specific facts of the case, a professional with a bachelor's degree and progressive post-baccalaureate experience may qualify for the underlying EB-2 classification.

​

Second, receiving an RFE, even one addressing all three NIW requirements, does not determine the outcome of a petition. A well-supported response that thoroughly addresses the officer's questions can still lead to approval.

​

Third, approval of an NIW petition does not automatically result in permanent residence. Visa Bulletin movement, National Visa Center processing, embassy interview availability, and changes in an applicant's personal circumstances can all influence the path to a green card.

​

Finally, immigration strategy is not always static. As circumstances changed throughout this case, the family reassessed their available options and selected the approach that best aligned with their goals and timeline.

​

The journey that began with an NIW petition filed from South Korea in December 2023 ultimately concluded with Adjustment of Status approval in July 2026. Along the way, the case demonstrated that successful immigration often involves more than obtaining an approved petition—it requires careful planning, flexibility, and the ability to adapt as opportunities and circumstances evolve.
