EB-5 Investment Immigration: Receiving a U.S. Green Card

Published: 2025.09.11
For those who dream of living and working freely in the United States, the one thing they most want to pursue
is surely obtaining a U.S. green card.

The U.S. EB-5 investment immigration program is well known as a route where a foreign national invests above a set amount in a U.S. business and creates 10 or more jobs
in order to obtain a green card.

There are direct and indirect investment methods, and most cases go through a regional center.
The investor, a spouse, and unmarried children under 21 are all eligible to apply,
and proving the lawful source of the investment funds is essential.

Since its introduction in 1990, more than about 100,000 people have obtained U.S. green cards through EB-5.

Among recent Korean EB-5 investors there are even cases of permanent green card approval just 4 months after the petition to remove conditions, so
if the process is handled properly and precisely,
EB-5 investment immigration can carry you through to the green card without trouble

In particular, with EB-5 investment immigration there are a few things to keep in mind after receiving the green card.

U.S. residency requirement

= Staying outside the country for more than 6 months may be treated as abandoning the green card.

Tax filing obligation

= As a U.S. resident you must report worldwide income.

Eligibility to apply for citizenship

= Possible from 5 years after obtaining the green card.

Change of address

= Must be reported to USCIS.

EB-5 investment immigration and the E-2 investor visa are different.
EB-5 investment immigration aims at a green card, while E-2 is a non-immigrant investment visa unrelated to permanent residency.

You can also apply for EB-5 without entering the United States: file the I-526 from abroad, and
after the interview enter the country to receive conditional permanent residency.

U.S. investment immigration involves a large sum, a complex document process, and a long wait, so
it must be done together with an experienced specialist.
